Last Updated: August 14, 2026

GHS Environmental, LLC (“GHS Environmental,” “GHS,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy describes how we may collect, use, disclose, and otherwise process personal information when you visit www.ghsenvironmental.com and other websites or online services that link to this Privacy Policy (collectively, the “Website”), contact or communicate with us, request information about our services, or otherwise interact with GHS.

This Privacy Policy also describes certain practices relating to information we receive in connection with our environmental consulting and professional services. Information provided to GHS in connection with a particular client engagement may also be governed by the applicable professional services agreement, confidentiality agreement, governmental contract, subcontract, or other arrangement. To the extent such an agreement imposes requirements concerning particular client or project information that differ from this Privacy Policy, the applicable agreement will govern with respect to that information.

1. Information We Collect

The information we collect depends on how you interact with us and the services involved. We may collect the following categories of information.

·  the subject and content of your inquiry; and

·  other information you voluntarily include in your communication.

We use information submitted through the Contact Us form primarily to receive, evaluate, and respond to your inquiry and to communicate with you concerning the subject of your request.

The Contact Us form is not intended as a portal for transmitting project files, confidential technical information, or other sensitive information. If it becomes necessary to exchange such information in connection with a prospective or existing engagement, GHS may provide an appropriate means for doing so.

In the course of providing environmental consulting, water-resource, hydrogeologic, permitting, geographic information system (“GIS”), ecological, monitoring, well-related, and other professional services, GHS may receive or develop information relating to clients, properties, facilities, projects, and other persons or entities.

Such information may include, depending on the engagement:

·  records supplied by governmental entities or other public sources; and

·  other information reasonably necessary to perform or administer our professional services.

Project information is not necessarily “personal information.” However, where project data identifies or can reasonably be associated with an individual, household, property owner, employee, client representative, or other natural person, we will handle that information in accordance with this Privacy Policy and applicable law.

D. Information From Other Sources

We may receive information from third parties, including:

Because our services frequently involve regulatory, permitting, environmental, water-resource, and public-sector matters, we may provide information to federal, state, regional, or local governmental authorities, regulatory agencies, water management districts, utilities, municipalities, or other public entities where reasonably necessary to perform an engagement, obtain or maintain a permit or approval, satisfy reporting requirements, respond to an agency request, or comply with applicable law.

D. Legal and Protective Purposes

We may disclose information if we believe disclosure is reasonably necessary to:

·  comply with applicable law, regulation, subpoena, court order, public-records requirement, or other legal process;

Accordingly, GHS cannot guarantee that information submitted in connection with a governmental or public-sector project will remain confidential where disclosure is required by applicable law, contract, governmental policy, subpoena, records request, or other lawful process.

Where a contract or applicable law imposes specific requirements regarding project information, GHS will handle that information in accordance with those requirements.

5. Cookies and Similar Technologies

Our Website is hosted through GoDaddy and uses GoDaddy's standard website analytics functionality to help us understand general Website usage and performance. This functionality may collect technical and usage information such as browser and device information, Internet Protocol (“IP”) address, pages viewed, dates and times of visits, and similar Website activity.

GoDaddy may use cookies or similar technologies in connection with its hosting, security, Website functionality, and analytics services. GHS uses the resulting information to understand Website traffic and usage, maintain and improve the Website, and support Website security and performance.

GHS does not currently use third-party advertising pixels, remarketing technologies, or behavioral advertising tools on the Website.

You may be able to control certain cookies through your browser settings or through cookie or privacy controls made available through the Website or GoDaddy platform. Disabling certain technologies may affect Website functionality.

For additional information regarding information processed by GoDaddy in connection with its services, you may review GoDaddy's applicable privacy disclosures.

6. Do Not Track and Privacy Preference Signals

Some Internet browsers permit users to transmit “Do Not Track” signals. Because there is no generally accepted industry standard for responding to traditional Do Not Track signals, our Website does not currently respond to those signals. GHS does not currently sell personal information or use personal information collected through the Website for targeted or cross-context behavioral advertising. If applicable law requires GHS to recognize a legally valid browser-based privacy preference signal in connection with a regulated activity, GHS will respond as required by applicable law.

7. Sale, Sharing and Targeted Advertising

GHS does not sell personal information for monetary or other valuable consideration.

GHS also does not currently use personal information collected through the Website for cross-context behavioral advertising or targeted advertising, and does not disclose personal information to advertising networks or similar third parties for those purposes.

We may disclose personal information to service providers and contractors that process information on our behalf for legitimate business purposes, including Website hosting, information technology, communications, security, accounting, and similar operational services. We may also disclose information as otherwise described in this Privacy Policy, including in connection with professional engagements, legal obligations, and governmental or regulatory matters. Such disclosures are not made for purposes of selling personal information or targeted advertising.

8. Data Retention

We retain personal information and project information for as long as reasonably necessary for the purposes for which the information was collected or otherwise processed.

Retention periods may vary based on factors including:

·  the nature and duration of the client engagement;

·  contractual obligations;

·  governmental or regulatory requirements;

·  professional licensing and recordkeeping requirements;

·  applicable statutes of limitation;

·  insurance requirements;

·  accounting and tax requirements;

·  litigation holds or anticipated disputes; and

·  legitimate business and professional needs.

When information is no longer reasonably required, we may delete, anonymize, archive, or otherwise dispose of it in accordance with our policies and applicable legal or contractual requirements.

9. Data Security

We maintain administrative, technical, and physical safeguards that we consider reasonable and appropriate in light of the nature of the information we maintain and our business operations.

However, no Internet transmission, information system, or method of electronic storage can be guaranteed to be completely secure. Accordingly, we cannot guarantee the absolute security of information transmitted to, stored by, or otherwise processed by GHS.

The Website's Contact Us form is intended for general inquiries and communications and should not be used to transmit confidential project files, sensitive technical information, or other information requiring special security precautions. Please do not submit Social Security numbers, financial account or payment-card information, health or medical information, government-issued identification numbers, account passwords or credentials, or other sensitive personal information through the Website's Contact Us form.

10. Your Privacy Choices and Rights

Depending on where you reside and subject to applicable law, you may have certain rights concerning your personal information. These may include rights to:

·  request information about personal information we maintain about you;

·  request access to certain personal information;

·  request correction of inaccurate personal information;

·  request deletion of certain personal information;

·  obtain a copy of certain personal information; or

·  opt out of certain uses or disclosures of personal information.

These rights are subject to exceptions, limitations, verification requirements, and other conditions under applicable law. For example, we may retain information that we are required or permitted to maintain for legal, contractual, professional, regulatory, security, recordkeeping, or claims-related purposes.

To submit a privacy request, please contact us using the information in the “Contact Us” section below. We may request information reasonably necessary to verify your identity and the applicability of the request.

We will not unlawfully discriminate against an individual for exercising an applicable privacy right.

11. California Website Users

California law may require operators of commercial websites that collect certain personally identifiable information from California consumers to disclose their online information practices. The categories of information GHS may collect through the Website, the categories of third parties with whom such information may be disclosed, our practices concerning browser-based tracking signals, and our procedures for changes to this Privacy Policy are described above.

If GHS becomes subject to additional California privacy requirements, we will provide any additional notices and rights required by applicable law.

12. Third-Party Websites and Services

Our Website may contain links to websites, platforms, or services operated by third parties. We do not control and are not responsible for the privacy, security, content, or practices of third-party websites or services.

The inclusion of a third-party link does not necessarily constitute an endorsement of the third party’s privacy or security practices. We encourage you to review the privacy policies applicable to any third-party website or service you use.

13. Children’s Privacy

Our Website and professional services are directed to businesses, governmental entities, organizations, property owners, and adults seeking environmental or professional consulting services. They are not directed to children under 13 years of age.

We do not knowingly collect personal information online from children under 13. If we learn that we have collected personal information online from a child under 13 without appropriate authorization, we will take reasonable steps to delete the information as required by applicable law.

14. Email and Business Communications

If you communicate with GHS by email, telephone, Website form, or another method, we may retain the communication and use the information provided to respond to you, administer our relationship with you, provide services, maintain appropriate records, and carry out other legitimate business purposes.

If GHS sends promotional email communications, you may opt out of receiving such communications by following the unsubscribe instructions contained in the applicable message or by contacting us. Opting out of promotional communications will not prevent GHS from sending non-promotional communications relating to an existing client relationship, project, transaction, legal obligation, or other business matter.

15. Changes to This Privacy Policy

We may revise this Privacy Policy periodically to reflect changes in our business practices, Website, services, technology, legal requirements, or other circumstances.

When we revise this Privacy Policy, we will update the “Last Updated” date above. Where required by applicable law, we may provide additional notice regarding material changes.

We encourage you to review this Privacy Policy periodically.

These Terms of Use (“Terms”) govern your access to and use of the website located at www.ghsenvironmental.com, including any pages, content, features, or functionality available through the website (collectively, the “Website”).

The Website is owned and operated by GHS Environmental, LLC (“GHS Environmental,” “GHS,” “we,” “us,” or “our”).

By accessing or using the Website, you acknowledge that you have read and agree to these Terms. If you do not agree to these Terms, you should not use the Website.

1. Informational Purpose Only

The Website provides general information regarding GHS, its experience, capabilities, personnel, projects, and professional services.

Information presented on the Website is provided for general informational and business-development purposes only. Website content is not intended to constitute, and should not be relied upon as, professional engineering, geological, hydrogeological, environmental, ecological, permitting, regulatory, scientific, legal, or other professional advice or services.

Environmental, geological, hydrogeological, water-resource, permitting, regulatory, and similar matters are highly dependent on site-specific conditions, available data, applicable law, regulatory requirements, project objectives, and other circumstances. Information presented on the Website should not be used as a substitute for project-specific professional analysis or advice.

You should not take or refrain from taking action concerning a particular property, project, permit, environmental condition, regulatory matter, or other technical matter based solely on information contained on the Website.

2. No Professional or Client Relationship

Your access to or use of the Website does not create a client, consultant, professional, fiduciary, contractual, or other professional relationship between you and GHS.

Submitting an inquiry through the Website's Contact Us form, sending an email, telephoning GHS, or otherwise communicating with GHS does not, by itself, create a professional-services relationship or obligate GHS to accept an engagement, provide services, or respond to a particular inquiry.

A professional-services relationship with GHS is established only through an agreement or other arrangement expressly accepted or authorized by GHS.

Until such a relationship has been established, you should not provide GHS with confidential project information, sensitive technical information, privileged information, trade secrets, or other information that you expect GHS to maintain as confidential.

3. Contact Us Form and Electronic Communications

The Website's Contact Us form is intended for general inquiries concerning GHS and its services.

You should not use the Contact Us form to transmit:

  • confidential project files or sensitive technical data;
  • Social Security numbers;
  • financial account or payment-card information;
  • health or medical information;
  • government-issued identification numbers;
  • passwords, access credentials, or authentication information; or
  • other information requiring heightened security or confidentiality.

If GHS determines that confidential or sensitive information should be exchanged in connection with a prospective or existing engagement, GHS may provide or approve an appropriate means for doing so.

Electronic communications, including communications transmitted through the Website or by ordinary email, may not be secure. You assume the ordinary risks associated with transmitting information electronically.

4. Professional Services and Separate Agreements

Any professional services provided by GHS are governed by the applicable proposal, professional-services agreement, work order, task order, subcontract, confidentiality agreement, governmental contract, or other agreement applicable to the engagement.

These Terms do not alter, amend, supersede, or replace the terms of any such agreement.

If there is a conflict between these Terms and a written agreement governing professional services provided by GHS, the written professional-services agreement will control with respect to the matters covered by that agreement.

5. Accuracy and Availability of Website Information

GHS seeks to provide useful and accurate information on the Website, but Website content may contain errors, omissions, outdated information, or information that is incomplete or no longer applicable.

Projects, personnel, certifications, licenses, service offerings, regulatory requirements, technical information, and other circumstances may change without corresponding immediate changes to the Website.

GHS does not represent or warrant that Website content is complete, current, accurate, suitable for any particular purpose, or applicable to any particular property, project, jurisdiction, or circumstance.

GHS may modify, remove, suspend, or discontinue any portion of the Website at any time without notice.

6. Project Examples and Technical Information

The Website may describe past or current projects, professional experience, methodologies, environmental conditions, regulatory matters, maps, figures, photographs, technical concepts, or other project-related information.

Such information is provided only to illustrate GHS's general experience and capabilities. Conditions, results, regulatory requirements, methodologies, and conclusions associated with one project should not be assumed to apply to another project.

Any maps, diagrams, figures, photographs, measurements, technical information, or similar materials displayed on the Website are not intended for surveying, engineering design, construction, permitting, regulatory compliance, navigation, property-boundary determination, environmental decision-making, or other project-specific reliance unless expressly identified otherwise in a professional work product issued by GHS for the applicable purpose.

7. Governmental and Public-Sector Information

GHS performs services for and interacts with governmental bodies, regulatory agencies, utilities, water management districts, municipalities, and other public entities.

Information concerning governmental or public-sector projects may be subject to applicable public-records, governmental disclosure, records-retention, auditing, procurement, or similar requirements.

Nothing on the Website should be interpreted as a representation that information associated with a governmental or public-sector project is confidential, exempt from disclosure, or otherwise protected from a lawful governmental or public-records request.

8. Intellectual Property

Unless otherwise indicated, the Website and its contents, including text, graphics, logos, photographs, images, designs, maps, figures, layout, compilation, and other materials, are owned by or licensed to GHS and are protected by applicable copyright, trademark, and other intellectual-property laws.

Subject to these Terms, GHS grants you a limited, nonexclusive, revocable, nontransferable right to access and use the Website for lawful informational and business purposes.

Except as permitted by applicable law or with GHS's prior written authorization, you may not:

  • reproduce, republish, distribute, display, transmit, modify, or create derivative works from Website content;
  • use Website content for commercial publication, resale, or redistribution;

  • use the Website to infringe the intellectual-property, privacy, confidentiality, or other rights of GHS or another person; or
  • attempt to circumvent security or access controls associated with the Website.

GHS may restrict or terminate access to the Website where reasonably necessary to protect the Website, GHS, its clients, or others.

10. Third-Party Websites and Services

The Website may contain links to websites, applications, platforms, or services operated by third parties.

Third-party links are provided for convenience or informational purposes. GHS does not control and is not responsible for the availability, content, accuracy, security, privacy practices, terms, products, or services of third-party websites or services.

The inclusion of a link does not necessarily constitute GHS's endorsement, sponsorship, or approval of the third party or its content.

Your use of third-party websites and services is governed by the terms and policies applicable to those third parties.

11. Privacy

Your use of the Website is also subject to the GHS Environmental, LLC Privacy Policy, which describes how GHS may collect, use, disclose, retain, and otherwise process personal information.

The Privacy Policy is incorporated into these Terms by reference for purposes of explaining GHS's privacy practices.

12. Website Accessibility

GHS seeks to make information concerning its services reasonably accessible to Website users, including individuals with disabilities.

Additional information concerning Website accessibility is available in GHS's Accessibility Statement[SR1] .

Nothing in this section is intended to expand, waive, limit, or otherwise determine any rights or obligations that may exist under applicable law.

13. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ALL CONTENT AVAILABLE THROUGH THE WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

GHS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, ARISING BY LAW OR OTHERWISE, WITH RESPECT TO THE WEBSITE AND ITS CONTENT, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, GHS DOES NOT WARRANT THAT:

  • THE WEBSITE WILL BE AVAILABLE AT ALL TIMES OR WITHOUT INTERRUPTION;
  • THE WEBSITE WILL BE FREE OF ERRORS, DEFECTS, HARMFUL COMPONENTS, OR SECURITY VULNERABILITIES;
  • WEBSITE CONTENT WILL BE COMPLETE, ACCURATE, CURRENT, OR SUITABLE FOR A PARTICULAR PURPOSE; OR
  • INFORMATION OBTAINED THROUGH THE WEBSITE WILL PRODUCE ANY PARTICULAR TECHNICAL, REGULATORY, ENVIRONMENTAL, COMMERCIAL, OR OTHER RESULT.

Some jurisdictions may not permit certain warranty exclusions, in which case the foregoing exclusions apply only to the extent permitted by applicable law.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GHS AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO, USE OF, INABILITY TO USE, OR RELIANCE ON THE WEBSITE OR ITS CONTENT.

WITHOUT LIMITING THE FOREGOING, GHS WILL NOT BE LIABLE FOR LOSSES ARISING FROM:

  • RELIANCE ON WEBSITE CONTENT FOR A PROJECT-SPECIFIC, TECHNICAL, ENVIRONMENTAL, REGULATORY, PERMITTING, PROPERTY, OR BUSINESS DECISION;
  • ERRORS, OMISSIONS, OR OUTDATED WEBSITE INFORMATION;
  • INTERRUPTION OR UNAVAILABILITY OF THE WEBSITE;
  • MALICIOUS SOFTWARE, SECURITY EVENTS, OR OTHER HARMFUL TECHNOLOGY TRANSMITTED THROUGH THIRD-PARTY NETWORKS OR SERVICES; OR
  • THIRD-PARTY WEBSITES OR SERVICES LINKED TO OR FROM THE WEBSITE.

THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF GHS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless GHS and its members, managers, officers, employees, agents, and representatives from claims, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your unlawful use of the Website, your material violation of these Terms, or your infringement of another person's rights through your use of the Website.

This Section does not apply to the extent a claim results from GHS's own conduct for which liability cannot lawfully be shifted or limited.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles.

To the extent a dispute arising solely from use of the Website is properly subject to contractual venue selection, you agree that any judicial proceeding concerning these Terms or your use of the Website will be brought in a state or federal court of competent jurisdiction located in Pinellas County, Florida, and you consent to personal jurisdiction in those courts.

This provision does not alter any dispute-resolution, governing-law, or venue provision contained in a separate agreement between you and GHS. Any such separate agreement will control with respect to disputes governed by that agreement.

17. Changes to These Terms

GHS may revise these Terms periodically to reflect changes in the Website, our practices, legal requirements, or other circumstances.

When these Terms are revised, GHS will update the “Last Updated” date above. Revised Terms will apply prospectively from the date they are posted unless otherwise stated or required by law.

Your continued use of the Website after revised Terms become effective constitutes acceptance of the Terms then in effect.

18. Severability and Waiver

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

GHS's failure to enforce a provision of these Terms on one occasion does not waive its right to enforce that provision or any other provision in the future.

These Terms, together with the Privacy Policy and any other policies expressly incorporated into these Terms, constitute the agreement between you and GHS concerning use of the Website.

These Terms do not supersede or modify any professional-services agreement, confidentiality agreement, subcontract, governmental contract, or other separate written agreement between GHS and another party.
